Show cause Notice under section 5 of the Environment (Protection) Act, 1986 for Non- Compliance of Plastic Waste Rule, 2016 (as amended)
The Central Pollution Control Board (CPCB) has issued show cause notices under section 5 of the Environment (Protection) Act, 1986 for Non- Compliance of Plastic Waste Rule, 2016 (as amended). This directive has targeted on Producer(P), Importer (I) and Brand Owner (BO) who have failed to fulfill their Extended Producer Responsibility (EPR) obligations.
Main Provisions of the Notice -:
- Failure to file Annual Returns (AR):
- Many Producers, Importers, and Brand Owners (PIBOs) have not filed their AR for the FY 2022-23 and 2023-24 despite of extended guidelines by CPCB.
- Non-compliance may result in auto filing of reports and additional penalties.
- Shortfall in EPR targets fulfillment:
- EPR targets assigned to PIBOs for plastic packaging waste must be deposited in Metric Tons (MT) in Cat I, Cat II, Cat III and Cat IV.
- Any shortfall in fulfillment of EPR targets may lead to Environmental Compensation (EC) and increase EPR targets for upcoming years.
- Legal Consequences:
- Units failing to comply with EPR obligations may risk legal actions under the provision of the Environment (Protection) Act, 1986.
